Overview

This agreement (the “Agreement”) establishes a contract between you (“you” or “the user”) and Fluffy Feast Inc. (“Fluffy Feast,” “we,” “us,” “our,” or “the Company”). It governs the terms related to the ordering and receipt of Fluffy Feast pet food, content, and other products (the “Products”) as well as the services (the “Service”) provided through our website, fluffyfeast.ca, including any subdomains and associated platforms such as mobile applications (collectively referred to as the “Website”). Please read these terms and conditions carefully before using our Service.

By accessing our Website and/or purchasing from us, you agree to engage in our “Service” and to be bound by the following Terms and Conditions (“Terms of Service” or “Terms”). These Terms apply to all users of the Website, including but not limited to browsers, vendors, customers, merchants, and content contributors.


Please carefully review these Terms of Service before using our Website. By accessing any part of the Website or utilizing our services, you acknowledge and accept these Terms. If you do not agree with all the terms and conditions outlined in this Agreement, you are not authorized to access the Website or use any of our services. If these Terms of Service are deemed an offer, acceptance is explicitly limited to the Terms stated herein.


Any new features or tools added to our store will also be governed by these Terms. You may review the most current version of the Terms of Service on this page at any time. We reserve the right to modify, update, or replace any part of these Terms by posting changes on our Website. It is your responsibility to periodically review this page for updates. Your continued use of the Website following any modifications constitutes your acceptance of the revised Terms.


Our store is hosted on Shopify Inc., which provides us with an e-commerce platform to facilitate the sale of our products and services.


The term “Residents of Québec” refers to individuals residing in Québec who enter into agreements subject to the Consumer Protection Act (Québec).



Part I – Terms of Sale

1.1 Our services are offered through a subscription (the “Subscription”). By registering for a Subscription, you agree that: (a) Fluffy Feast (or an authorized third-party payment processor) is permitted to charge your credit card for the Subscription, and we will continue charging you until you cancel your Subscription; (b) if you wish to “skip” a week, “pause,” or cancel your Subscription, you must notify us at least forty-eight (48) hours before your next billing cycle (billing cycles for monthly subscriptions occur on the 1st and 15th of each month, while yearly and half-yearly subscriptions renew every 12 months and 6 months, respectively, from the purchase date); (c) the amount charged per week may change if you modify your plan selection, take advantage of a Special Offer, apply Credits, or if there are changes in applicable taxes or other charges; (d) the Service is designed to provide you with specially curated pet food and treats; and (e) you may receive promotional information related to the Service.

1.2 All prices are listed in Canadian dollars and include applicable sales taxes:

  • Ontario: 13% HST

  • New Brunswick, Newfoundland and Labrador, Nova Scotia, Prince Edward Island: 15% HST

  • Alberta, British Columbia, Manitoba, Northwest Territories, Nunavut, Quebec, Saskatchewan, Yukon: 5% GST

  • Our prices include 9.975% QST where applicable in the province of Québec


1.3 We are not responsible for completing any transaction that cannot be processed by our payment provider due to insufficient funds or other issues. If your transaction is declined, you will receive an error message, and the transaction will not be completed. Additionally, we may temporarily suspend your Fluffy Feast account until payment details are updated and the payment is successfully processed. A paused account does not exempt you from any outstanding payment obligations.


1.4 For more details on pricing and Subscription plans, please review your Fluffy Feast account. By subscribing, you acknowledge and agree to the terms and conditions associated with your selected Subscription plan.


Part II – Return Policy

2.1 All Fluffy Feast products are final sale and non-returnable. Due to the nature of our pet food and treat products, we do not accept returns or offer refunds. We are committed to maintaining the highest standards of quality and safety, ensuring that all products meet our strict guidelines before shipment.


2.2 We encourage customers to inspect their orders upon delivery. If you believe that a product has been damaged during transit or is otherwise unsuitable for use, please contact us immediately at fluffyfeast24@gmail.com with details and photographic documentation of the issue. Our team will assess the situation and determine an appropriate resolution. Fluffy Feast is dedicated to providing high-quality products and customer satisfaction, and we appreciate your understanding of our return policy.


Part III – Eligibility for Use

The Services provided by Fluffy Feast are intended for individuals aged 18 and above. By using our Services, you confirm and warrant that: (a) you are at least 18 years old, (b) you have not been previously suspended or removed from our Services, nor engaged in any activities that could result in such suspension or removal, (c) you do not hold multiple accounts for the use of our Services, and (d) you possess the legal authority to enter into this Agreement without violating any other agreements to which you may be a party.


Part IV - Delivery

4.1 We provide nationwide shipping within Canada, excluding Nunavut, the Yukon, and the Northwest Territories.


4.2 Fluffy Feast primarily utilizes third-party courier services for shipping. As a result, all purchases are subject to a shipping contract under which the title and risk of loss for the Products transfer to you upon delivery. Once the Products have been delivered, their handling, storage, and consumption become your responsibility. Fluffy Feast is not liable for any actions or inactions of third-party couriers and shall not be held responsible for any delays, losses, or damages occurring while the shipment is in transit.


4.3 Estimated shipping times and delivery dates are provided for reference only and may be affected by weather conditions or unforeseen circumstances beyond our control. If such events prevent us from delivering your Products on the scheduled date, we will attempt to fulfill the delivery as soon as possible. If delivery remains impossible, we will issue a full refund or store credit equivalent to the purchase price of the affected order. If we cannot complete a delivery due to issues caused by you (e.g., an incorrect address or failure to receive the package), you remain responsible for the purchase price of the Products.


4.4 Delivery is considered complete once the third-party courier follows the instructions you have provided. If an individual is present at the delivery location, we assume they are authorized to accept the package on your behalf. If no one is present, the package will be left at the specified delivery location. It is your responsibility to ensure that the delivery instructions you provide are accurate and complete.

4.5 Upon delivery, you are responsible for inspecting all Products for damage or other concerns, including their freshness. If you believe that any delivered Product is unsuitable for consumption, please contact us immediately, and we will address the issue in accordance with our Return Policy.


4.6 You assume full responsibility for the Products once they have been delivered in accordance with the instructions you have provided.


4.7 After receiving your order and inspecting the Products, it is your responsibility to store them in a cool, dry place and follow proper food safety guidelines. This includes adhering to safe food handling practices recommended by the Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) and the Canadian Food Inspection Agency (CFIA) to minimize the risk of foodborne illness.


Part V – Special Offers

5.1 We may occasionally provide promotional offers to new or existing customers related to their use or potential use of our Services or the purchase of Products (each a “Special Offer”). The terms and conditions of each Special Offer will be detailed alongside the offer or communicated separately. These offers may include, but are not limited to, discounted prices for a specified period upon the creation of a Fluffy Feast account or in exchange for customer reviews.


Part VI – Account Credits

6.1 In certain circumstances, we may issue promotional credits (“Credits”) that will be automatically applied to future purchases through your Fluffy Feast account or used to offset Subscription costs. Credits are promotional in nature, non-transferable, and can only be redeemed as instructed by us. They cannot be exchanged for cash or any other form of compensation.


6.2 Credits are only available if you maintain both an active Fluffy Feast account and an active Subscription. If you cancel your Subscription or Fluffy Feast account, any remaining Credits will be forfeited. Credits may only be used once they have been successfully applied to your account. All disputes regarding Credit balances will be resolved at our sole discretion.


Part VII – Termination

You may pause or cancel your Fluffy Feast account or Subscription at any time through the Fluffy Feast online portal or by contacting our customer support team via live chat or email at fluffyfeast24@gmail.com. We reserve the right to suspend, pause, or terminate your access to the Service if you are found to be in breach of this Agreement or for any other serious reason.


Part VIII – Disclaimer of Warranties; Limitation of Liability

8.1 We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free.


8.2 We do not warrant that the results obtained from using the Service will be accurate or reliable.


8.3 You acknowledge that we may remove the Service for indefinite periods or cancel the Service at any time without prior notice.


8.4 You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all Products provided through the Service are, unless explicitly stated otherwise, provided on an "as is" and "as available" basis, without any representations, warranties, or conditions of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.


8.5 In no event shall Fluffy Feast, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, but is not limited to, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any other similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise. Such liability may arise from your use of the Service or any Product purchased through the Service, or from any other claim related to your use of the Service or any Product, including errors or omissions in content, or any loss or damage incurred as a result of the use of the Service or any content (or Product) made available via the Service.


Because some jurisdictions do not permit the exclusion or limitation of liability for consequential or incidental damages, in such cases, our liability shall be limited to the maximum extent permitted by law.

Part IX – Indemnification

You agree to defend, indemnify, and hold harmless Fluffy Feast, along with its officers, directors, affiliates, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, but not limited to, reasonable legal and accounting fees, arising from or in any way related to your access to or use of the Service, as well as your Fluffy Feast Account in connection with such use.


Part X – Amendment

Fluffy Feast reserves the right to modify this Agreement, in whole or in part, at any time. Any such amendment will: (i) Be communicated to you via notifications on our website and email notifications to existing customers.  (ii)  Include either the revised section only or both the amended and original sections for comparison. (iii) Indicate the date on which the amendment takes effect. (iv) If the amendment increases your obligations or reduces Fluffy Feast’s obligations, you will have the right to reject the amendment and terminate the Agreement without penalty or cancellation fees by notifying Fluffy Feast within 30 days of the amendment's effective date.


If you wish to reject an amendment, you may do so by clicking “I Do Not Agree” when the amendment is presented to you. Refusal of an amendment will result in the termination of the Agreement, the automatic deactivation of your Fluffy Feast Account, and the loss of access to the Service.


Part XI – General Provisions

11.1 This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario, Canada, and the applicable federal laws of Canada. Both parties irrevocably submit to the jurisdiction of the courts in the district of Toronto, Province of Ontario.


11.2 This Agreement represents the entire and exclusive understanding between you and Fluffy Feast regarding the Service and supersedes any prior agreements. However, this Agreement may be supplemented by the terms of any Special Offer provided to you.


11.3 You may not assign or transfer this Agreement, or any of your rights or obligations under it, to any third party without prior written consent from Fluffy Feast, which may be granted or withheld at our sole discretion. No assignment or delegation by you shall relieve you of your obligations under this Agreement. Subject to the foregoing, this Agreement shall be binding upon and enforceable by both parties and their respective successors and assigns. Fluffy Feast reserves the right to assign this Agreement to a third party without requiring your consent.


11.4 Nothing in this Agreement shall be interpreted as creating a partnership or joint venture between you and Fluffy Feast.


11.5 If any provision of this Agreement is found to be invalid by a court of competent jurisdiction, that provision shall be severed from the Agreement without affecting the validity or enforceability of the remaining provisions.
